Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the MyGrowPal mobile application (the "App"), provided by MyGrowPal ("we", "us" or "our"). By downloading, creating an account or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App.

2. Who we are

The App is operated by MyGrowPal. You can contact us at any time at ciaran@mygrowpal.app.

3. Eligibility

You must be at least 13 years old (or the minimum age required to consent to data processing in your country) to use the App. By using MyGrowPal, you confirm that you meet this requirement and that the information you provide is accurate.

4. Your account

To use most features you must create an account using a valid email address and password. You are responsible for:

• keeping your login credentials confidential;
• all activity that happens under your account; and
• notifying us promptly of any unauthorised use.

We are not liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure.

5. Acceptable use

When using the App, you agree not to:

• use the App for any unlawful purpose or in breach of these Terms;
• upload content that is illegal, infringing, harmful, or that you do not have the right to share;
• attempt to gain unauthorised access to the App, our systems or other users' data;
• interfere with, disrupt, overload or reverse-engineer the App or its underlying services;
• use automated means to scrape or extract data from the App; or
• misuse the AI features (for example, by submitting content unrelated to gardening that is abusive or unlawful).

6. Your content

The App lets you create and upload content such as photos of seed packets and plants, journal entries, notes, garden layouts and logs ("Your Content"). You retain ownership of Your Content.

By uploading Your Content, you grant us a limited, non-exclusive licence to store, process and display it solely for the purpose of operating the App and providing its features to you (including sending relevant images to our AI provider for analysis, as described in our Privacy Policy). You are responsible for ensuring you have the right to upload Your Content and that it does not infringe anyone else's rights.

7. AI features & gardening guidance

MyGrowPal uses artificial intelligence to identify seed packets, suggest growing guidance and help diagnose plant health. This guidance, along with weather forecasts, sowing schedules and other information in the App, is provided for general informational purposes only.

8. Third-party services

The App relies on third-party services to function, including Supabase, Google Gemini, Open-Meteo, Postcodes.io and Expo. Your use of features that depend on these services may also be subject to their own terms. We are not responsible for the availability, accuracy or content of third-party services. The App is also distributed through the Google Play Store, and your use is additionally subject to Google Play's terms.

9. Intellectual property

The App, including its name, logo, design, text, graphics and software (but excluding Your Content), is owned by or licensed to MyGrowPal and is protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive and revocable licence to use the App for your own personal, non-commercial gardening use. You may not copy, modify, distribute, sell or lease any part of the App without our permission.

10. Availability & changes to the App

We aim to keep the App available and working well, but we provide it on an "as available" basis. We may add, change, suspend or remove features at any time, and we may carry out maintenance that temporarily affects availability. We are not liable if the App is unavailable for any period.

11. Suspension & termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the App, or where we are required to do so by law. On termination, your right to use the App ends; provisions that by their nature should survive (such as content licences for backups, disclaimers and limitations of liability) will continue to apply.

12. Disclaimers

To the fullest extent permitted by law, the App and all content and guidance are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that gardening outcomes will meet your expectations.

13. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law. Subject to that, to the fullest extent permitted by law:

• we will not be liable for any loss of crops, plants, harvests, profits, data or other indirect or consequential loss arising from your use of the App; and
• our total liability to you for all claims connected with the App is limited to the amount you have paid us to use the App (which, where the App is free, is nil).

As a consumer, you have legal rights that are not affected by these Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where the changes are significant, take reasonable steps to notify you. Your continued use of the App after changes take effect means you accept the updated Terms.
